Temporary licenses and permits


(1)

The board may issue a temporary license to practice for a period of four months to an applicant for licensure by endorsement pursuant to the occupational credential portability program.

(2)

The board may issue a permit to practice as a practical or professional nurse for a period not to exceed two years or as determined by the board to any person from another state or a territory of the United States or a foreign country who is in this state for special training or for observation of nursing educational programs upon proof to the board by the person that he or she is currently licensed to practice as a nurse in the state, territory, or country of residency. The nursing practice permitted by the permit shall be limited to that practice performed as part of the special training or nursing educational program.

(3)

The board may, as it deems appropriate, issue a permit to a person who is under the supervision of a professional nurse licensed pursuant to this part 1.

(4)

A person holding a permit may engage in the practice of practical or professional nursing only under the personal and responsible supervision and direction of a person licensed by the board to engage in the practice of professional nursing.

(5)

The board shall summarily withdraw a temporary license or permit issued pursuant to this section if the board determines that the temporary license or permit holder fails to meet the requirements of this section or section 12-255-109, 12-255-110, 12-255-111.5, or 12-255-114. The holder of a temporary license or permit summarily withdrawn has the right to a hearing that shall be conducted pursuant to article 4 of title 24 and section 12-20-403 by the board or by an administrative law judge at the board’s discretion.
