Authority of the executive director and chief procurement officer

(1)

Consistent with the provisions of this code, the executive director may adopt operational procedures governing the internal functions of the department.

(2)

(a)

The executive director may promulgate rules in accordance with the “State Administrative Procedure Act”, article 4 of this title 24, in furtherance of the administration of this code.

(b)

The executive director may delegate his or her authority to promulgate rules.

(c)

No rule promulgated pursuant to this section shall change any commitment, right, or obligation of the state or of a contractor under a contract in existence on the effective date of such rule.

(3)

Subject to rules, the executive director may delegate his or her purchasing authority to designees or to any department, agency, or official.

(4)

Except as otherwise specifically provided in this code, the chief procurement officer shall, pursuant to rules:

(a)

Procure or supervise the procurement of all supplies and services needed by the state;

(b)

Repealed.

(c)

Establish and maintain programs for the inspection, testing, and acceptance of supplies and services;

(d)

Retain the right to examine each requisition submitted by a using agency and approve, disapprove, or revise it as to quantity or quality;

(e)

Develop and maintain programs and procedures to delegate purchasing authority in order to conserve resources for management of the statewide purchasing system; and

(f)

Develop programs to evaluate and reduce the administrative costs of the statewide procurement function.
