Powers and duties of board

(1)

The board shall regulate the practice of podiatry and is a
type 1
entity, as defined in section 24-1-105. The board exercises, subject to this article 290, the following powers, duties, and functions:

(a)

Adopt and from time to time revise rules pursuant to section 12-20-204, including rules governing advertising by licensees to prevent the use of misleading, deceptive, or false advertising;

(b)

Examine, license, and renew licenses of duly qualified podiatric applicants;

(c)

Make investigations, hold hearings, including hearings upon complaints concerning disciplining podiatrists, and take evidence in accordance with section 12-20-403 in all matters relating to the exercise and performance of the powers and duties vested in the board;

(d)

Cause the prosecution of and seek injunctions in accordance with section 12-20-406 against all persons violating this article 290; and

(e)

Approve or refuse to approve podiatric colleges.

(2)

The authority granted the board under the provisions of this article 290 shall not be construed to authorize the board to arbitrate or adjudicate fee disputes between licensees or between a licensee and any other party.
