C.R.S. Section 25-11-108
Exemptions


(1)

Sections 25-11-103 and 25-11-104 do not apply to the following sources or conditions:

(a)

Electrical or other equipment or material that is not intended primarily to produce radiation and that, by nature of design, does not produce radiation at the point of nearest approach at a weekly rate higher than one-tenth the appropriate limit generally accepted by the medical profession for any critical organ exposed. The production testing or production servicing of such equipment shall not be exempt.

(b)

Radiation machines during process of manufacture or in storage or transit. The production testing or production servicing of such machines shall not be exempt.

(c)

Repealed.

(d)

Sound and radio waves and visible infrared and ultraviolet light.

(2)

No exemptions under this section are granted for those quantities or types of activities which do not comply with the established rules and regulations promulgated by the atomic energy commission or any successor thereto.

(3)

Section 25-11-107 shall not apply to unmined minerals containing radioactive materials including such as are involved in mining operations.
(4)(Deleted by amendment, L. 2010, (HB 10-1149), ch. 282, p. 1320, § 7, effective May 26, 2010.)(5) Any person may file application for exemption under this section for activities including, but not limited to, licensed sources of radiation for educational or noncommercial public displays or scientific collections.
