Section 24-50-1107
Rights of covered employees
(1)
Covered employees shall have the right to self-organization; to form, join, or assist an employee organization; to engage in the partnership process and the formation of a partnership agreement collectively through representatives of their own choosing; to engage in other concerted activities for the purpose of the partnership process or other mutual aid or protection; and shall also have the right to refrain from any or all such activities, without interference, restraint, or coercion by the state or employee organization.(2)
Covered employees have the right to communicate with one another and with employee organization representatives concerning organization, representation, workplace issues, the partnership process, and the business and programs of certified employee organizations by means of e-mail systems, texts, other electronic communications, telephone, paper documents, and other means of communication subject to reasonable restrictions.(3)

Within sixty days of June 16, 2020, the state shall complete a one-time notification process to inform each covered employee of the option to direct the state not to provide a certified employee organization the covered employee’s home address, home and personal cellular phone numbers, and personal e-mail address.(b)
The state shall inform new employees, within thirty days of their start date, of the option to opt out pursuant to subsection (3)(a) of this section.(c)
At any time, a covered employee may direct the state to not provide the employee’s home address, home and personal cellular phone numbers, and personal e-mail address. A covered employee may rescind such request at any time.(d)
Any communication by the state pursuant to this subsection (3) shall be subject to the requirements of section 24-50-1111 (7)(a) and shall be neutral with respect to the employee’s exercise of this option.(4)
The interference with the rights as stated in this section by the state or certified employee organization constitutes an unfair labor practice subject to review pursuant to section 24-50-1113 (3).
