Section 25-1-103
State board of health created
(1)

There is created the state board of health, referred to in this part 1 as the “board”. The board is a(I)
One member from each congressional district in the state; and(II)
Two members from the state at large.(b)
A vacancy on the board occurs whenever any member moves out of the congressional district from which the member was appointed. A member who moves out of such congressional district shall promptly notify the governor of the date of the member’s move, but the notice is not required for the vacancy to occur. The governor shall fill any vacancy by appointment for the unexpired term.(c)
No more than a minimum majority of the members of the board may be affiliated with the same political party.(d)
The term of office for each appointed member is four years. In making appointments to the board, the governor shall ensure that no business or professional group constitutes a majority of the board. In making appointments to the board, the governor is encouraged to include representation by at least one member who is a person with a disability, as defined in section 24-34-301, a family member of a person with a disability, or a member of an advocacy group for persons with disabilities if the other requirements of this subsection (1) are met.(2)
There shall always be one county commissioner member on the board. Whenever a county commissioner ceases to hold the office of county commissioner, the commissioner ceases to hold a position as a member of the board. A county commissioner shall not vote on any matter coming before the board that affects the commissioner’s county in a manner significantly different from the manner in which it affects other counties.
